New Senate bill would ban dismemberment abortion nationwide, with prison for doctors who perform it
Most Americans have never been told what a dismemberment abortion actually involves, and the abortion industry prefers it that way. A new bill in the United States Senate is about to force that conversation into the open.
On the fourth anniversary of the Dobbs decision that overturned Roe v. Wade, Sen. Cindy Hyde-Smith of Mississippi, chair of the Senate Pro-Life Caucus, joined by Sen. Mike Rounds of South Dakota, introduced the Dismemberment Abortion Ban Act of 2026, according to the joint announcement from the senators' offices. The legislation would establish a federal prohibition on dilation and evacuation abortions, the procedure in which a living unborn child is grasped with surgical instruments and extracted from the womb piece by piece.
Under the bill, physicians who knowingly perform dismemberment abortions would face fines and up to two years in federal prison. Mothers would face no prosecution of any kind. The legislation targets the practitioners who profit from the procedure, not the women who are so often pressured and abandoned into it.
The scale of what is at stake is staggering. Supporters of the ban note that dismemberment procedures account for roughly 80 percent of all second trimester abortions in the United States, taking tens of thousands of lives every single year. These are children with beating hearts, developing brains, arms, legs, fingers, and toes.
Rep. Kat Cammack of Florida has introduced companion legislation in the House, meaning both chambers of Congress will have the opportunity, and the obligation, to act.
Whatever the bill's immediate prospects, it accomplishes something the abortion lobby fears most: it makes lawmakers go on record. Every senator and every representative will have to answer a simple question in front of the voters: do you believe it should be legal to tear a living child apart in the womb? There is no hiding from that question, and with the midterm elections approaching, there is nowhere to hide from the voters either.
