A federal judge has blocked Michigan from enforcing a law that would have forced pro-life pregnancy centers to hire staff who oppose their mission and to carry health insurance covering abortion.
The U.S. District Court for the Western District of Michigan ruled Friday that Right to Life of Michigan and a pregnancy resource center, represented by Alliance Defending Freedom (ADF), are likely to succeed in their challenge to the law, which redefined "sex discrimination" under Michigan employment rules to include the "termination of a pregnancy." The court denied the state's motion to dismiss the case and asked the Michigan Supreme Court to weigh in on how the law applies before the case proceeds further in federal court.
Under the law as written, pro-life organizations across Michigan could have been required to hire job applicants who support abortion, even for positions central to their pro-life mission, and to provide employee health coverage for abortion, directly contradicting the reason these organizations exist.
"For these pro-life groups, the messenger matters," said ADF Senior Counsel Bryan Neihart, describing why the government cannot force an organization built to protect unborn children to employ people working against that very purpose.
President Trump's administration has consistently sided with pro-life organizations against state mandates that would force them to compromise their mission, and this case is another example of federal courts pushing back against states attempting to use employment law against pregnancy centers.
Michigan's law reflects a broader trend among pro-abortion state legislatures seeking new ways to pressure pro-life organizations after the Dobbs decision returned abortion policy to the states. Pregnancy centers like the plaintiffs in this case provide free counseling, medical services, and material support to mothers choosing life for their unborn children, often as the only alternative many women encounter to an abortion business.
